in our today's work schedule we have the voting of a Judicial treaty between Ducato di Milano-Italia and Somerset County.

Justice cooperation’s treaty between Milan’s Duchy and Somerset County


In their almighty wisdom, the Lords Lord_justinian, Count of Somerset, and KleeOtr, Duke of Milan, wished to express their friendship by establishing a judicial treaty binding Duchy of Milan and Somerset citizens to preserve that friendship over years.

Article I – About cooperation principle
1. If an accused person flees from a territory allied by this treaty in an attempt to flee justice, he will be either extradited or judged, by mutual agreement by duly appointed judicial authorities upon who's lands he was arrested.

Article II – About requesting law
Concerning the mutual agreement, it implies a full cooperation between prosecutors and judges from both countries in order that the defendant receive a judgment he would have received if he hadn't fled. The accused should also be provided a competent defence council by the Country in which he was arrested.

Article III – About judgement procedure
The procedure will be the following :
- Indictment on demand by the Duchy holding jurisdiction over the crime committed. Requesting Duchy prosecutor will write the bill of indictment. Proof of Evidence against the accused will be required from the Requesting Duchy to the responding Duchy prior to posting of any indictment.
- The whole procedure is under the primary jurisdiction of the requesting duchy. The Local responding Judge will write the sentence, but will show motives of his decision following the law of the requesting duchy.

Article IV – About officer’s cooperation
Collaboration is required between juridical authorities from both duchies in order to keep the laws of both the requesting and responding Duchies respected.
Juridical officers (Public Prosecutor, Judge, Sergeant, Captain and Constable ) will cooperate about:

- sharing information about person or group of person who are identified as potentially dangerous;

- enforcing the law when a criminal is in the territory of one of the contracting countries and an offence is committed.

Article V – About the request
Issued by an officer of one of the contracting duchies, it have this form:

Article VI – About added dispositions
The added dispositions, in particular about accused’s rights will discussed by Judge, Public Prosecutor and Constable of both countries. The contracting’s Chamberlain will archive the preceedings.

Article VII – About treaty validity
If a contractor disregards his fidelity to the King or the Emperor, this treaty is considered automatically cancelled.

Article VIII – About treaty disregards
In peacetime as in war contest, disregard of any clause(s) within this treaty frees the other party of his commitment until a compensation is made/or agreements can be reached.

Article IX – About treaty cancellation
To Cancel: A mail from the Duke will be sent to the other Duke. This one has 4 working days to answer. If a official response won’t arrive this treaty will be considerate cancelled. The contractor bind themselves to publish an official and formal declaration in the Duchy's Inn.

Article X – About treaty modification
A full or partial rewriting of the treaty or even his cancellation can be decided by mutual consent.
This treaty is written in English and in Italian language, and both version have the same validity and validity.

Trattato di cooperazione giudiziaria tra il Ducato di Milano e la Contea del Somerset.

Nella loro grande saggezza, KleeOtr, Duca di Milano e, Lord_justinian, Conte del Somerset, hanno chiesto di mettere per iscritto il presente trattato di cooperazione giudiziaria che vincola i popoli del ducato di Milano e la Contea del Somerset.

Articolo I - del principio di cooperazione
Ogni individuo che ha commesso un'offesa o un crimine nei confronti della legge e delle regole viginenti nel territorio di un contraente dovrà, su domanda, essere ricercato, recepito, messo in carico ed essere giudicato dal contraente sul territorio del quale l'individuo si trova o è sospettato di trovarsi.

Articolo II - dell'applicazione del diritto del ricorrente
L'indagine, l'arresto, la messa a giudizio, essendo il giudizio svolto per e da delegazione del contraente che ha emesso la richiesta (chiamato ricorrente), il contraente sul territorio del quale questi passi sono effettuati si impegna a rispettare il diritto del contraente richiedente (sul territorio del quale ha avuto luogo l'infrazione).

Articolo III - della procedura di giudizio
Il procuratore del ricorrente redige l'atto d'accusa premurandosi di fare apparire le leggi o abitudini sui quali l'atto si basa. Lo trasmette al suo omologo, che renderà l'atto d'accusa successivamente.

Il giudice richiedente deve ricevere i dettagli del processo.

Articolo IV - della cooperazione dei Prefetti e dei corsi di giustizia
I membri della prefettura, della giustizia e delle delle alte parti contraenti (Prefetti, Capitani, Sergenti, Giudici, Cancellieri, Procuratori) si impegnano a collaborare attivamente:

- condividendo le loro informazioni sugli individui o gruppi di individui identificati come potenzialmente pericoloso. Informano così, esprimendo un parere di cautela, che può influire su un contraente sul suo territorio;

- osservando la giustizia quando un'offesa o crimine è stata commessa e che l'imputato è sul territorio di un contraente. Esprimono allora un parere di ricerca, che è una richiesta destinata a procedere all'indagine, all'arresto, di accusa, ed il giudizio della persona accusata.

Articolo VI - delle disposizioni allegate
Le modalità allegate, in particolare quelle relative ai diritti degli accusati saranno discusse dai giudici, procuratori e Prefetti dei contraenti. I cancellieri dei contraenti procederro all'archiviazione dei processi.

Articolo VII - della validità del trattato
Qualora un contraente non abbia rispettato o abbia rotto la sua fedeltà a suo Re o il suo imperatore, il presente trattato può essere de facto denunciato automaticamente dall'altro contraente, senza indugio, senza che nessuna compensazione possa essere imposta. Il trattato denunciato è immediatamente considerato come nullo.

Articolo VIII - degli inadempimenti al trattato
In tempo di pace come in guerra, qualsiasi inadempimento al presente trattato o annullamento di quest'ultimo non conforme all'articolo qui di seguito può aprire il diritto ad una compensazione della parte danneggiata.


Articolo IX - della procedura di denunzia del trattato
Il contraente che desidera porre fine al presente trattato dovrà fare pervenire una lettera ufficiale di denunzia all'altro contraente. Quest'ultimo dispone di quattro giorni lavorativi per prendere atto. Senza risposta ufficiale che lo accenna, il presente contratto è considerato passato nullo questi termini. Le parti contraenti si impegnano a pubblicare in modo ufficiale una lettera che precisa l'abrogazione del contratto.

Articolo X - della modifica del trattato
Per consenso reciproco, la riscrittura del trattato può essere effettuata nella sua integrità o parzialmente.

Articolo XI - dell'entrata in vigore del trattato
l presente trattato entra in vigore senza limitazione di tempo fin dalla firma da parte dei contraenti, che impegna le loro terre ed i loro popoli.
Il presente trattato è scritto in due versioni, una italiana e una inglese. Le due versioni hanno lo stesso valore ed efficacia.

May I respectfully inquire why this is taking place in the Public Council Room? And without two days of discussion? (ooc. I could not decide whether to post this or not, I know some will think I am doing it for political reasons, but I assure you I am not. I ultimately decided to post this to stay in Character as the PP.)

Our Legal Corpus dictates the following:
