| Subject: Question about Defence Councel Tue Oct 02, 2007 11:15 pm | |
| I received this question from a citizen - Quote :
- Art. 1.4.9. : Whosoever is accused of a crime in the County of Somerset, shall have the right to a Defence Counsel. This Defence Counsel shall have access to evidence under the right to disclosure, and shall provide mitigating evidence, testimony, witnesses, and may argue points of law regarding only the accused’s criminal charges.
In accordance to this law any person/s accused of a crime is entitled to a defence counsel....
I have a few questions about that:
As a member of the law society of England, I feel that I am ready to act in a defence counsel, yet are there any other criterium for taking part in a defence counsel?
Do I have to register my services or anything like that?
How does the in game side to it work, like if i act as a defence counsel, AmI permitted to post where the defendent posts? And if not where do I put my
" mitigating evidence, testimony, witnesses, and may argue points of law regarding only the accused’s criminal charges. "?
Any other info would be apreciated
Sorry for any inconveniances I have accosted,
Yours Humbly,
Lethion I don't know what to tell him, anyone have and ideas

| The "defense council" law is a part of the Somerset legal corpus. I believe the applicant to serve as a somerset defense council is reviewed and voted for approval by the Somerset council. | |

| Yes true,i think Poliphilus was also asked for an approval back then from Lord Hypno.
I am not so sure how the procedure works ingame, because i never saw the Judge menu, but if you can call witness, let's say he can be the one. He can ask details in the chamber of Law Society of England, i am sure they know more about his ingame options.
Tell him he has the approval of the County Council to work on this field.
Justice in Somerset has to be open to all.

| I love legal questions! - Legal Corpus wrote:
Article 3 – Defense Counsel procedure.
Art. 3.3.1. : The Defense Counsel is a person that offer their service to defend someone or help a witness in the judicial process of the court. They can charge a fee for their service.
Art. 3.3.2. : The Defense Counsel must be recognized by the County Council to be able to work in Somerset as an official lawyer for the county.
Art. 3.3.3. : The Defense Counsel must have not commit any crime except slavery in the past 6 months in any kingdom of the world, or should have received official forgiveness by the Regent of England or the Duke of Somerset.
Art. 3.3.4. : The Defense Counsel, when hired by someone, can ask to have access to all reports that the prosecutor have on this case, and the prosecutor must make all reports available to Defense Council. If the proof cannot be shown and is private due to security reason, then the Defense Counsel must keep it private and if he doesn’t, his right to practice in Somerset will be revoked and will be charged with treason against Somerset.
Art. 3.3.5. : At any time the Duchy Council can revoke the right to practice to a person who practices as Defense Counsel. All cases already in Court with that person as the Defense Counsel can continue with that person as Defense Counsel. No new cases can be taken up by the person
As for the ig mechanics this gets tricky. Technically the Defence Council (DC) cannot post in IG trials. Only the PP (defending the County and Victim), the Accused (representing her/himself), and then the Judge can actually post. Witnesses may be calld, but that wouldn't be the DC since they are not technically witnesses to the crime. What the DC could do would be to write all the defenses (actual wording) and then send them to the accused who would then post them ig. Some counties (and we should adopt this) have trials on the forums which will allow for DC, the problem with this is that it would require a player to have a forum account, which we cannot require. I will further inquire with the Law Society, and some of my fellow law-lovers. Hope this helps in the meantime though. For Somerset!
