Lawsuit between GeorgiaGeorgia and Somerset

Bill of indictment

Quote :
It is alleged GeorgiaGeorgia hired Ladyvee for 12,00 £ in the town of Bridgewater. GeorgiaGeorgia has violated Artical 2.2.3 in the Legal Corpus of Somerset. Which states

Artical. 2.2.3. :Slavery is defined as any attempt to hire someone with an indecent wage. The minimum decent wage is the minimum wage declared by the concerned Town Hall through decrees, otherwise the minimum wage of the Duchy, minimum wage of the duchy is 15 pounds. An exception can be made for helping another citizen, for a religious service act or for a redemption act. The Judge can recognize the a private contract that goes below the minimum wage on the condition that this arrangement was announced to the lieutenant of police of the town in public. Slavery is a light crime, thus the sentence will be a fine at the discretion of the Judge. A repeat offense of slavery will be a moderate crime.

Evidence to the crime can be found here -
http://forum.renaissancekingdoms.com/viewtopic.php?t=23196&start=81

It is written in the Legal Corpus of Somerset in Article. 2.1.5. : Confession of a crime can lower the degree of the sentence.

The Defendant can choose to confess his crime, defend himself, or seek legal assistance if he so wishes.

First defence pleading

Quote :
Hi i did it accidentally in my rush. Then i could not fix it.I am sorry.

Prosecutor indictment

Quote :
As every crime, slavery consists of an action described by the law as such and a frame of mind which can be characterised as either negligence or intent. The defendant's action has been adequately proven by the evidence presented. It has also been confessed. What the defendendant questioned was her criminal intent. And there comes the question whether intent is necessary for the crime of slavery to be constituted. The text of the law does not give us a direct answer. Nevertheless, whenever the law requires intent for a crime to be constituted it says so expressively. In the case of roberry ,for example, intent of first degree (...goal...)is required. It seems logical to me to assume that in the crimes ,for the constitution of which, intent is not expressively defined as necessary, negligence is enough. This is an argumentum e silentio (=argument by the silence=whenever the law makes no distinction, the interpretor cannot make one either) in order to prove that slavery is punishable even when commited out of negligence. I therefore,Your Honour, propose that the defendant is found guilty.

As to the adequate punishment of the defendant I suggest Your Honour a fine proportionate to the defendant's disrespect towards the law and the victim. That is your Honour a fine of no less than 30 pounds. But no more than 50 pounds either, given the confession of the crime and the defendant's blank criminal record.

What I also consider important Your Honour,is that you set a precedence regarding whether slavery is punishable even when commited out of negligence.

Last defence pleading

Quote :
The defendant didn't present to the Court.

The prosecutor called Lord_Rian

Quote :
At the time i thought it damn selfish for a person with no obvious money problems to offer such low wages.

Personally I would drop the case if the defendant could make it up to the ‘slave’ in this case, but since the crime has been officially reported and testified to, it is up to the court to pronounce sentence.

The prosecutor called Ladyvee

Quote :
His statement:
Being a reasonibly new resident of Somerset(not knowing 'the ropes'), I was unaware of minimum wages and so forth, and as I do not have very high strength pints, the job offered by GeorgiaGeorgia for no intelligence or strength points for £12 seemed to be a good offer.

Statement of accusation
The defendant has been proved guilty of slavery.

Quote :
GeorgiaGeorgia, you have confessed your crime, thus I give you a lighter sentence. I sentence you to a fine of 15 pounds for the crime itself. I also order you to pay 10 pounds to Ladyvee.

If you wish to appeal this case, please approach the Court of Appeals at the following address : http://forum.renaissancekingdoms.com/viewforum.php?f=98

The defendant has been sentenced to 15 pounds fine.
