Ka Versus Somerset county

Bill of indictment

Quote :
It is alleged that on the 16th of January, 1455, Ka, a citizen of Plymouth of Cornwall, robbed Merces_Letifer just outside Salisbury and violated Article 2.2.2. of the Legal Corpus of Somerset. Which states the following

Article. 2.2.2. : A robbery is defined as any action, the goal of which is to steal the goods of someone else. This is a moderate crime.
A violent robbery is defined as any action, the goal of which is to steal the goods of someone else through the use of violence. This is a serious crime.
Organized robbery is defined as any action of robbery that negates the liberty of movement of the citizens and of goods in the Duchy. This is an infamous crime.

The evidence to the this case can be found here –

The Defendant can choose to defend himself, or seek legal assistance if he so wishes.

First defence pleading

Quote :
Your honnor,

I was starving somewhere between Chard and Bridgewater. I forgot to take some bread so I gently asked Merces_Letifer to give me something to eat. Unfortunately, the fact that I was not shaved and maybe my sword and schield (which I did not use !) scared him. He just left all his goods and ran away !
As a proof of what I'm saying, you can see that there were absolutly no violence.
I can give back Merces_Letifer his goods if he stops his lawsuit.

Your honnor thanks for paying attention,

Best Regards,

Sir Ka

Prosecutor indictment

Quote :
Your Honour,

The defendant Ka in his own defence plea has confessed to his crime, and therefore there is no doubt that he is guilty of robbing the victim.

I would also like to state that robbery is no simple mistake, but something that is usually carried out over 2 days (OOC Traveling to a node and then setting your options to rob)

However, Defendant Ka has stated in his defence plea that he would like to return his goods to the victim Merces_Letifer. If the Defendant can meet up with the Victim in Bridgewater and hand over the stolen goods and money within 3 days, and provide proof to the Judge and myself that this has been done, I recommend that he be sentenced to a minimal fine of 1 pound. However if he fails to return the stolen goods and money back to Merces_Letifer within the stated time period, or provide insufficient proof that he has done so, I recommend that he be sentenced to a heavy fine including but not limited to the value of all the stolen goods and money. Sir Ka has been a citizen of the Kingdom of England for a long time now, and he should be aware that the consequences of an offence such as robbery are severe.

Last defence pleading

Quote :
The defendant didn't present to the Court.

The prosecutor called Merces_Letifer

Quote :
Yeah, i was travelling back to my home town of Salisbury from Plymouth, and the journey had been quite en-eventfull, until i left chard and headed here. I was robbed by Ka, and he took quite alot from me ( 100 pounds, 2 staffs, 3 loaves and 10 fish)The evidence has been presented above and i now have to stay here for a few days to recuperate and get enough food for my journey home

The prosecutor called Jellysnail

Quote :
His statement:
As a clarification regarding the bill of indictment, the robbery happened on the road between Chard and Bridgewater. The victim called Merces_Letifer was travelling from Chard to Salisbury when he was robbed. He is currently recuperating in Bridgewater.

Statement of accusation
The defendant has been proved guilty of public disorder.

Quote :
Defendant Ka,
This Court finds you guilty on the count of public disorder, specifically on the charge of robbery as stated in Article. 2.2.2. of the Legal Corpus of Somerset.

You have admitted to your crime, that you did indeed rob the complainant Merces_Letifer on the road between Chard and Bridgewater. As a consequence of that robbery, not only did he lose his worldly possessions amounting to 100 pounds, 2 staffs, 3 loaves and 10 fish, but he has also suffered physically from starvation.

Also while you did indeed state here in Court that you would be happy to return the stolen goods and money to Merces_Letifer, in a later mail to him (OOC https://s103.photobucket.com/albums/m132/Southpark_619/?action=view&current=ka.jpg), you have gone as far as to mock him by saying that you cannot be fined because you have left Somerset. This indirect disrespect of the Court cannot go unpunished as well.

You are a scholar (OOC level 3), a noble (OOC Sir Ka, Lord of Travels), and you were once even elected mayor of Plymouth, a great town of England. And yet you have robbed an innocent man of his goods. For a person like you to stoop so low is indeed all the more appalling.

Thus this Court hereby fines you a sum of 750 pounds, 550 pounds being the commensurate fine for the stolen goods and money, and 200 pounds for mocking the victim and this Court by stating that you have escaped the reach of the Law. Nay, sir, the reach of the law is long indeed as you shall soon find out.

In addition, this Court also sentences you to serve out 7 days in prison, where you may meditate on the law and your wrongdoings.

If you wish to appeal this case, please approach the Court of Appeals at the following address : http://forum.renaissancekingdoms.com/viewforum.php?f=98

The defendant has been sentenced to prison penalty 7 days.
